Deadline for feedback Sept. 16
WorkSafeBC is looking for feedback on a discussion paper and new proposed policy on OHS injunctions.
OHS injunctions, under the Workers Compensation Act, βare an effective tool to achieve compliance with health and safety requirements when other measures are unsuccessful,β according to the discussion paper.
Currently, WorkSafeBC has no policy regarding these injunctions and a policy would increase awareness of these injunctions as a compliance tool and provide guidance to WorkSafeBC regarding their use, it said.
WorkSafeBC began using OHS injunctions in 2008. Since then, WorkSafeBC has applied to the British Columbia Supreme Court on three occasions for OHS injunctions and the injunctions were granted in all three cases.
The proposed policy contains two sets of factors. The first set identifies circumstances when an injunction could be a useful tool and the second set provides guidance βin determining whether it is necessary and appropriate to pursue an injunction in the circumstances,β said the discussion paper.
The deadline for submissions is Sept. 16.
