REGINA (CP) — Judges with the Saskatchewan Court of Appeal are considering the case of a man convicted of hitting and killing a young flag worker in a construction zone.
Last year, Keith Dunford was found guilty of dangerous driving causing the death of Ashley Richards, 18, who had just started on the job near Midale, Sask.
He was sentenced to just under two years in jail along with a three-year ban on driving.
His lawyer, Aaron Fox, argued that Dunford had not been properly instructed by police about his right to council. Fox said his client should have been given an opportunity to speak to a lawyer prior to his interview with police.
Fox also argued his client's driving did not constitute a marked departure from the norm, and his conduct should not be considered criminal.
Dunford will continue to be on bail until the appeal court judges make their decision, which Fox said could take weeks or even months.
